Acceptance of Terms
By accessing or using VitiScribe (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including vineyard managers, field workers, compliance officers, and any person who accesses the platform.
Description of Service
VitiScribe is a vineyard compliance and field operations platform that provides spray log management, PHI/REI calculators, tank mix calculators, GDD tracking, disease risk assessments, compliance report generators, and related vineyard management features. The Service includes both free tools and paid subscription plans as described on our pricing page.
User Accounts
To access certain features of the Service, you must create an account. You are responsible for:
- Providing accurate and complete registration information.
- Maintaining the confidentiality of your account credentials.
- All activities that occur under your account.
- Notifying us immediately of any unauthorized use of your account.
You must be at least 18 years old to create an account. VitiScribe reserves the right to suspend or terminate accounts that violate these terms.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable agricultural or environmental regulations.
- Attempt to gain unauthorized access to other accounts, systems, or networks.
- Upload or transmit viruses, malware, or other harmful code.
- Interfere with or disrupt the integrity or performance of the Service.
- Scrape, crawl, or use automated means to access the Service without our written consent.
- Submit falsified spray logs or compliance data for the purpose of deception or regulatory fraud.
Intellectual Property
The VitiScribe platform, including its design, code, features, branding, and documentation, is owned by VitiScribe and protected by intellectual property laws. You retain ownership of the vineyard and compliance data you enter into the platform.
By using the Service, you grant VitiScribe a limited license to use your data solely for the purpose of providing and improving the Service. We will not sell your data to third parties.
Payment and Subscriptions
Paid plans are billed on a recurring basis (monthly or annually) as selected at the time of purchase. Prices are subject to change with reasonable notice. Refunds are handled on a case-by-case basis. You may cancel your subscription at any time, and your access will continue until the end of the current billing period.
Limitation of Liability
VitiScribe is provided “as is” and “as available.” To the fullest extent permitted by law, VitiScribe disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
VitiScribe shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, revenue, or profits.
VitiScribe is a vineyard management tool and does not replace professional agronomic or legal advice. PHI/REI calculations and compliance reports are generated based on user-provided data and should be verified by qualified personnel. Users are solely responsible for ensuring compliance with all applicable federal, state, and local regulations. Always consult a licensed pesticide advisor or agricultural consultant for compliance decisions.
Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of account termination.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration.
Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Your continued use of VitiScribe after any modifications constitutes acceptance of the updated Terms.
